1. Authorisation

1.1. You are engaging FreedomWP (Formerly WeasiPeasi), as an independent contractor to perform work as described in the package(s) or service(s) you have purchased. In the event access to your website is necessary, you hereby authorise FreedomWP access and “write permissions” to all directories and files of your account with any other third party hosting provider, as well as permission to install any necessary WordPress plugins for maintenance and security.

2. Providing the Services

2.1. As required by law, we will provide the services with as high skill and care as possible, consistent with best practices and standards in the website support industry, and in accordance with any information provided by us about the services offered as part of our plans.

2.2. We will begin providing the services after the information requested in the signup process has been provided and we have confirmed we have been able to access and setup the services. You are responsible for providing this information in a timely manner. The payment for the renewal of the service will be taken one month from the date of the first order confirmation, not from the date of activation.

2.3. We will continue renewing and providing the services until you inform us that you wish to cancel the services.

2.4. We will make every reasonable effort to complete the Services on time (and in accordance with your support plan). We cannot, however, be held responsible for any delays if an event outside of our control occurs.

2.5. If we require any information or action from you in order to provide the services, we will inform you of this as soon as is reasonably possible. Examples of what we may require include additional services logins or changes to settings inside your website or third party website hosting.

2.6. If the information or action required of you is delayed, incomplete or otherwise incorrect, we will not be responsible for any delay, failure or damage caused as a result. If additional work is required from us to correct or compensate for a mistake made as a result of incomplete or otherwise incorrect information or action on your part, We may charge you a reasonable additional sum for that work.

2.7. In certain circumstances, for example, where there is a delay in you sending us information or taking action required, we may suspend the Services (and will inform you of that suspension in writing).

2.8. We will aim to carry out support request within a 24 – 48-hour time frame. Please be aware that certain tasks or technical issues may take longer than others to carry out or resolve and may take longer than 48 hours. If this is the case, we will inform you of the issues and keep you updated via email or through our support ticketing system.

3. Communication

3.1. We will communicate with your via email or through our ticketing system. No phone support is available.
We aim to get back to you within a 24 – 48-hour time frame.

3.2. Information about how to communicate with us will be given once you sign up for your service plan

4. Events Outside of Our Control

4.1. We will not be liable for any failure or delay in performing our obligations where that failure or delay results from any cause that is beyond our reasonable control. Such causes include, but are not limited to: power failure, internet service provider failure, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic or other natural disaster, or any other event that is beyond Our reasonable control.

4.2. If any event described under this clause occurs that is likely to adversely affect our performance of any of our obligations under these Terms and Conditions: We will inform you as soon as is reasonably possible;

4.3. Our obligations under these Terms and Conditions will be suspended and any time limits that we are bound by will be extended accordingly;

4.4. We will inform you when the event outside of our control is over and provide details of any new dates, times or availability of Services as necessary;

4.5. If an event outside of our control occurs and you wish to cancel, you may do so in accordance with your right to Cancel. Any refunds due to you as a result of that cancellation will be paid to you as soon as is reasonably possible, and in any event within 30 Calendar days of our acceptance of your cancellation notice;

4.6. If the event outside of Our control continues for more than 30 days, we reserve the right to cancel the contract. Any refunds due to you as a result of that cancellation will be paid to you as soon as is reasonably possible, and in any event within 30 calendar days of our cancellation notice.

5. Refusal of Service

5.1 FreedomWP reserves the right to refuse service to any individual, website, or blogs that contain offensive, obscene, hateful, malicious content or any other reason.
5.2. If we refuse service we will let you know via email. We will refund to you any payment made in that payment cycle.

6. Copyright

6.1. FreedomWP does not assume any responsibility or liability for the copyright of any content of the websites it manages, maintains and/or hosts.

6.2. All customer logo images, images unique to the customer, i.e. of their premises, workforce and their business, plus all written copy, belong to the customer and are covered under their copyright.

7. Pricing & Payments

7.1. All prices appearing on this site are subject to change without notice. Once a client of FreedomWP, you authorise FreedomWP to charge the payment method you submitted for all the invoices generated for the services rendered by FreedomWP.

7.2. Your payment will be billed once a month from the date you signed up for your account via Credit or Debit card. Your payment details are not stored or easily accessed.

7.3. Failed payments – If we fail to take a successful payment from your Credit or Debit card we will notify you of failed billing on a number of occasions – if we are unable to take a payment before your next billing cycle we will suspend your services until a payment has been made.

7.4. Upgrades – If you wish to upgrade your services from one plan to another you can do this through our website or we can do this for you once written permission is granted

8. Cancellation & Refunds

8.1. Cancellation of any monthly recurring service can occur at any time after your first 1 month (30 days) of service.

8.2. In order to cancel your recurring payment or change payment method, simply contact FreedomWP prior to your payment’s due date or you can cancel your plan within our website under your account.

8.3. No refunds are available after your purchased package or service has been started, unless otherwise specified in any authorised way by FreedomWP or under any special guarantees offered

9. Website Hosting

9.1.FreedomWP use high-performance web servers provided for optimal use with WordPress websites and offers unlimited bandwidth and an uptime performance of over 99.9%.

9.2. FreedomWP will include a monthly price for the hosting and associated technical support for customer websites.

9.3. FreedomWP will use their best endeavours to rectify the cause of any disruption in the hosting service of a customer’s website(s) and to minimise the duration of any such instances.

9.4. Hosting migration – If you wish to bring your website to us we will migrate your website to our servers for free – we will need your permission and login details in order to carry out the migration to our servers.

9.5. FreedomWP will not be liable to the customer for any compensation in respect of any downtime that may occur with the hosting of their website(s).

9.6. With regard to any images or download files uploaded to a customer’s website by a customer it is the responsibility of the customer to retain a copy of these on their local PC/LAN. In the unlikely event of hard drive failure or other technical failure with the web server it will be the responsibility of the Customer to re-upload these files.

9.7. In the event that a customer wishes to move their website and/or SQL Server Database to another web server supported by another party, then FreedomWP will cooperate fully, subject to all outstanding amounts being paid up in full.

9.8. In the event that the Customer requires assistance with remedying a situation with their website that is not a technical fault caused by FreedomWP the time expended by FreedomWP will be charged to the Customer in accordance with clause.

9.9. FreedomWP will invoice for hosting on a monthly basis advance.

9.10. FreedomWP offer no refunds if you cancel your hosting during your current billing period.

9.11. FreedomWP do not include SSL certificates for the website hosting. These can be purchased as a separate item through us and we will install and support this.

9.12. Third party website hosting

9.13. We will happily support your website on your website hosting. We will need all login details and permission to make any required changes on your hosting account or support tickets on your behalf.

9.14. Your support time will be used for any time taken in working with or talking to your hosting provider
9.15. We are not liable for any functionality or performance issues caused or downtime that occurs due to your third party website hosting. We will inform you of any issues we find with your third-party website hosting.

10. Email

10.1. FreedomWP do not offer email services as part of our plans. We are happy to help you to set up email accounts with Google Business or Office 365 email as part of your support time allocated inside your support plan(s).

10.2. We offer no support or take no liability for issues with email services you are using through external third party providers.

11. Search Engines

FreedomWP are experts at helping websites to perform well with the search engines and will liaise with customers in trying to achieve high rankings for the appropriate keyword phrases.

FreedomWP accept no responsibility or liability to the customer for the actual rankings achieved or how such rankings may vary over time.

FreedomWP will supply a price for SEO work either in the initial project quotation, or upon request by the customer.

12. Client Modification

12.1. You remain the ability to independently edit or update your web pages.

12.2. If anyone other than FreedomWP or its subcontractors attempts to update the website and damages the design or impairs the ability for the website to display or function properly, time to repair the website will be assessed using your support time or at an hourly rate of $120 per hour. There is a one-hour minimum.

13. Third Party Software

13.1. WordPress is a complicated system and plugin and theme conflicts are commonplace. FreedomWP takes no liability for any issues caused due to third-party plugins or core WordPress updates. We will endeavour to fix any issues as quickly as possible or rollback the website to a previous version.

13.2. Plugin licences – If any functionality of your website is stopped due to a licence expiring you will need to repurchase the licence and supply it to us to resolve the issue. We take no responsibility for functionality being impaired due to a licence expiring.
13.3. FreedomWP may supply third-party plugins to increase the performance or functionality of your website. If we supply these plugins as part of your support agreement we remain the right to remove the licence of these plugins if you cancel your service plan with us.

13.4. Other third-party software like marketing tracking tools can impair the performance of your website – We take no responsibility for any performance issues but third-party tracking tools.

14. Limitation of Liability; Disclaimer of Warranties

14.1. Although there are limitations to the guarantees we can provide, your satisfaction is very important to us. Please read and understand our limits of liability before ordering services.

14.2. FreedomWP does not guarantee, represent, or warrant that the functions contained on your website will function error-free.

14.3. You expressly agree that your use of, or inability to use, the functions contained in these web pages or website is at your sole risk. The functions of the web pages and the website created for you are provided “as is” and “as available” for your use, without warranties of any kind.

14.4. To the extent not prohibited by law, in no event will FreedomWP be liable to the client or any third party for any damages, including, but not limited to, any lost profits, lost savings, loss of data, business interruption, or incidental, consequential or special damages arising out of the operation of or inability to operate these web pages or website, however, caused, even if FreedomWP has been advised of the possibility of such damages.

14.5. FreedomWP does not represent, guarantee or warrant that the functions contained in these web pages or website will be free from loss, corruption, attack, viruses, interference, hacking, or other security intrusions, and FreedomWP disclaims any liability relating thereto.

15. Acceptance

15.1. Please note that by submitting your payment, you agree to all of our terms of service as they are written here. FreedomWP reserves the right to change or update these terms at any time without prior notice. The user of this site agrees to the terms of this agreement on behalf of his or her organisation or business. This Agreement constitutes the entire understanding of the parties. Any changes or modifications there to must be in writing and signed by both parties.
